Booking Conditions
All holidays are sold subject to the following conditions.
1. BOOKING: The signing of the booking form constitutes acceptance of these conditions by the client. The booking conditions still apply even if for some reason the booking form has not been completed e.g. a late booking by telephone. A binding contract will come into force between us at the time we send out our confirmation invoice.
2. YOUR HOLIDAY PRICE: We reserve the right to alter prices of any of the holidays shown in our brochure or web site. You will be advised of the current price of the holiday that you wish to book before your contract is confirmed. When you make your booking you must pay a deposit of 20% of the holiday cost. The balance of the price of your travel arrangements must be paid at least 9 weeks before your departure date. Deposit amounts and dates the balance becomes due may vary but will be advised at time of booking. If the deposit and/or balance is not paid in time, we shall cancel your travel arrangements. If the balance is not paid in time we shall retain all deposits paid. In the case of bookings made less than 9 weeks before the date of departure, full payment must accompany the completed booking form. Balance payments will be subject to a surcharge of 11/2% if paid by credit card. All monies you pay to a travel agent are held by him on our behalf. Changes in transportation costs, including the cost of fuel, dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports mean that the price of your travel arrangements may change after you have booked. However there will be no change within 30 days of your departure. We will absorb and you will not be charged for any increase equivalent to 2% of the price of your travel arrangements, which excludes any amendment charges. You will be charged for the amount over and above that. If this means that you have to pay an increase of more than 10% of the price of your travel arrangements, you will have the option of accepting a change to another holiday if we are able to offer one, or cancelling and receiving a full refund of all monies paid, except for amendment charges. Should you decide to cancel for this reason, you must exercise your righ to do so within 14 days from the date printed on your final invoice. Should the price of your holiday go down due to the changes mentioned above by more than 2% of your holiday cost, then any refund due will be paid to you. However please note that some apparent changes have no impact on the price of your travel due to contractual and other protection in place.
3. PASSPORTS AND VISAS: It is the client’s responsibility to ensure that all travel documentation is valid as airlines will not permit passengers to travel who do not have proper documentation and who cannot comply with all regulations. A full British Citizen Passport which does not expire before 6 months from the date of entry to the USA is required by all customers. Customers travelling to the United States who hold a full British Citizen Passport who are able to comply with the US Government immigration requirements can use the Visa Waiver Scheme and need not apply for a Visa. Holders of any other type of passport are advised to consult with the American Embassy for advice before booking their holiday.
4. BROCHURE ACCURACY: A great deal of care has been taken to ensure the accuracy of the information within this brochure. However, facilities and services may not be open or available due to renovation/maintenance works, adverse weather, management/ owners discretion etc. Where we are aware that a facility or service advertised in this brochure will not be available during the period of your holiday, we will take steps, wherever possible, to notify you prior to travel. Prices are correct at time of going to print but are subject to change. If this happens you will be informed before making your booking.
5. INSURANCE: The staff of The Vacations Group are not authorised to interpret any insurance policy or to make promises in respect of our cover. If you require clarification please contact our brokers (details on request). It is strongly recommended that you accept the insurance offered by The Vacations Group. However, you are entirely free to make your own arrangements provided that the resultant policy affords comparable cover. If you elect to make your own arrangements the person signing the booking form dissolves The Vacations Group of all possible liabilities which may arise due to the failure to take out adequate insurance.
6. SECURITY DEPOSIT: All bookings require a security and telephone deposit of £250 and your credit card details will be held on file for this purpose. Any charges arising from any long distance telephone charges, excess cleaning costs, excess electricity, replacement of lost keys and repairs for damage to a property or any of its contents will be debited from your card. If you do not hold a credit card a payment of £250 will be required. This deposit will be refunded within 60 days of the departure date. At most locations a credit card imprint will also be required locally.
7. FAMILY HOMES: Normal usage of gas, water and electricity is included in your holiday price. The reasonable cost of cleaning the property on your departure is also included. Guests are responsible for leaving the accommodation and its contents clean and in good order. The accommodation in this brochure is only for the use of passengers as confirmed by us; subletting, sharing or assignment is prohibited.
8. CANCELLATION BY YOU: If you wish to cancel your holiday, written notification must be given to The Vacations Group by the person who signed the booking form. The date of cancellation will be the date we receive this written notice. In the event of cancellation by you no insurance premiums paid will be refunded and the following cancellation charges will be payable by you.

9. ALTERATIONS BY YOU: If once the booking has been accepted by The Vacations Group you wish to make any alterations to the booking details, we will do all we can to assist provided that the request is made in writing by the person who signed the booking form. Some alterations may incur an administration fee from £25 per person affected by the change. Material alterations may be treated as a cancellation. Any alterations made by you less than 9 weeks before the date of departure may be treated by The Vacations Group as a cancellation and so subject to the cancellation charges referred to in paragraph 9 above.
10. CANCELLATION BY THE VACATIONS GROUP: The Vacations Group will not cancel your holiday after the balance of the holiday price has become due or when the balance has been paid, whichever is the latter, unless it has to do so as a result of any of the reasons referred to in paragraph 16 below or unless payment is not received by us by the due date. Subject to this The Vacations Group reserves the right to cancel your holiday in its absolute discretion at any time. In the event of cancellation by us we will inform you as soon as reasonably possible and you will be offered the choice of an alternative holiday of comparable standard if available or a full refund of any money you have paid plus compensation as detailed in paragraph 12 below.
11. CHANGES BY THE VACATIONS GROUP: Whenever possible all changes will be advised to you or your travel agent without delay. Should these changes be minor, alternative arrangements will be effected. Specific units may have to be changed due to circumstances beyond our control. However, should these changes be substantial we will where possible make alternative arrangements. A major change is deemed as a change of UK airport or time of departure by more than twelve hours. Any other change will be deemed “minor”. Should you choose not to accept these and once instructions have been received in writing from you, you will receive a prompt refund of all monies paid plus compensation of £10 per person if the major change is notified to you or your travel agent within 42 days of your departure or £25 if within 28 days of your departure. We will also pay you this compensation if you accept the change. Compensation will not be payable if we are forced to change or cancel as a result of any of the events set out in paragraph 16 below. Travel details are correct at time of printing. Any changes will be notified to you with your final documents. If we change your airline or aircraft from those stated in this brochure there will be no compensation or right to cancel by the client.
12. THE VACATIONS GROUP LIABILITY: (i) We accept responsibility for the acts and/or omissions of our employees, agents and suppliers save where they lead to death, injury or illness except as provided in (ii) below. Our liability in all cases shall be limited to a maximum of 2 times the holiday price of the person/s affected. (ii) We accept responsibility for death, injury or illness caused by the negligent acts and/or omissions of our employees or agents together with our suppliers and sub-contractors whilst acting within the scope of or in the course of their employment. We will accordingly pay to our clients such damages as might have been claimed in respect of such negligence, as accepted under English Law. We will make payments as stated above provided (a) the injured clients notify us of any claim for personal injury within 2 months of the holiday; (b) they assign to The Vacations Group any rights against a supplier or any other person or party they may have relating to the claim; and (c) they agree to co-operate fully with us should we or our insurers wish to enforce those rights which have been assigned to us or to which we are subrogated. This assignment is necessary to enable us to try to recover from suppliers any compensation paid to clients and associated costs as a result of personal injury to clients caused by the negligence of those suppliers. It is not our wish to profit from such assignment and in the event of our recovering more than such compensation and costs any excess will be paid to the injured clients. (iii) In respect of the services by air carriers, our liability in all cases shall be limited in the manner provided by international conventions. (iv) If you suffer death, illness or injury whilst overseas arising out of activity which does not form part of the foreign inclusive holiday arrangements, we shall at our discretion offer advice, guidance and assistance to help you in resolving any claim you may have against a third party provided we are advised of the incident within 90 days of the occurrence. Where legal action is contemplated our authority must be obtained prior to commencement of proceedings and be subject to your undertaking to assign any costs recovered or any benefits received under an appropriate insurance policy to ourselves. Our costs in respect of the above on behalf of you and your party shall not exceed £5,000.
13. TRAVEL/DELAYS: All transportation by air or land is subject to the terms and conditions of the company providing the transport. Timings for flight departures are estimates only. We cannot accept liability for any delay in your transportation from or to the UK. Where long flight delays result in lost holiday time, no refunds are given by suppliers nor do airlines offer compensation.
14 EXCURSIONS: Please note that we do not provide excursions. Our local representatives may, at your request, make arrangements for excursions locally on your behalf. However, please note that if they do, the contract for the provision of the excursion will be between you and the supplier of the excursion and not between you and us. Therefore, when you purchase an excursion locally, your contract is with the local company and we have no liability whatsoever for anything which may go wrong on the excursion.
15. FORCE MAJEURE: The Vacations Group accepts no responsibility for and shall not be liable in respect of any loss or damage or alterations, delays or changes arising from circumstances outside its control such as war or threat of war, riot, civil strife, industrial dispute, terrorist activity, natural and nuclear disaster, fire or adverse weather conditions, government action, technical problems with transport, closure or congestion of airports, cancellation or changes of schedules by airlines.
16. FOREIGN OFFICE ADVICE: The FCO may have issued information about your holiday destination. You can check this information on the Internet under the address www.fco.gov.uk/knowbeforeyougo or you can contact the ABTA Information Line on 0901 201 5050 (calls are charged at 50p a minute).
17. DATA PROTECTION AND PRIVACY POLICY: In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements, we need to use the information you provide such as name, address, any special needs/dietary requirements etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to the relevant suppliers of your travel arrangements such as airlines, hotels, transport companies etc. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law. We will also use the information for marketing purposes. Should you not wish to receive further information from The Vacations Group in the future, please advise our reservations staff at the time of booking.
18. IF YOU HAVE A COMPLAINT: In the unlikely event of there being something not to your liking whilst on holiday this must be notified to our local representative in order that the problem may be resolved amicably and as quickly as possible. If any such problem is unable to be resolved satisfactorily this must be notified immediately to The Vacations Group (an international freephone number is given to you). If we are unable to resolve the problem you must write to us within 28 days of your return. No action can be taken or liability accepted for complaints received after this period.
19.ARBITRATION: It is unlikely that you will have a complaint that cannot be settled amicably between us. However, disputes arising out of, or in connection with this contract which cannot be amicably settled may be referred to arbitration under a special scheme which, though devised by arrangement with ABTA is administered quite independently by the Chartered Institute of Arbitrators. The scheme (details on request) provides for a simple and inexpensive method of arbitration on documents alone with restricted liability on the client in respect of costs. Alternatively AITO’s Independent Dispute Settlement Service (again details on request) may be called upon by either side to bring the matter to a speedy and amicable solution. Whichever option you choose, neither scheme applies to claims for an amount greater than £5,000 per person/£25,000 per booking form, nor to claims which are solely or mainly in respect of physical injury or illness or the consequences of such injury or illness. Both the schemes have a time limit of 9 months from the return date of your holiday.
20. CONSUMER PROTECTION: We have observed the financial bonding requirements of ABTA, the Civil Aviation Authority and AITO Trust when arranging the holidays described in this brochure. The air holidays and flights in this brochure are ATOL Protected, since we hold an Air Travel Organiser’s License granted by the Civil Aviation Authority. Our ATOL number is ATOL 2976. In the unlikely event of our insolvency, the CAA will ensure that you are not stranded abroad and will arrange to refund any money you have paid to us for an advance booking. For further information, visit the ATOL website at www.atol.org.uk Our ABTA membership number is V5164. In addition, we have complied with the financial bonding requirements of the Regulations on Package Travel, Package Holidays and Package Tours effected in the UK from 1st January 1993.
21. JURISDICTION: Your contract is with The Vacations Group Ltd. This contract shall be governed by and construed in accordance with the laws of England. Any dispute arising hereunder shall be subject to the exclusive jurisdiction of the English courts.
